Stuart Bartow is a partner in the firm’s Intellectual Property practice group, and is co-managing partner of the Silicon Valley office. He represents clients from around the globe in intellectual property matters, with an emphasis on complex patent and trade secret disputes concerning high technology. 

Stuart’s primary expertise is in patent litigation in federal courts across the United States. He has participated in jury trials in various federal district courts, as well as appeals before the U.S. Court of Appeals for the Federal Circuit, investigations before the U.S. International Trade Commission, and centralization proceedings before the Judicial Panel on Multidistrict Litigation.  A registered patent attorney with a technical background in computer engineering and neuroscience, he also advises on intellectual property portfolio management, PTO practice under the America Invents Act, and licensing matters and related antitrust concerns for domestic and international clients.

Clients and peers alike have lauded Stuart for his legal and technical acumen.  For example, The Legal 500 has described Stuart as “strik[ing] the proper balance” between providing the highest-end client service and protecting the client’s long-term interests.

Before practicing law, Stuart served on the technical staff of a medical device company that commercialized technology developed in connection with Johns Hopkins University's School of Medicine and Applied Physics Laboratory. Stuart also acquired telecommunications experience working at a leading provider of global satellite services based in Washington, D.C.

In addition to his legal practice, Stuart has taught Intellectual Property law as an Adjunct Lecturer at the Santa Clara University School of Law. He is also a frequent author and speaker on IP law and high technology.

Representative Matters

  • Defended several Silicon Valley technology companies in a multi-district litigation concerning web communication technology. As liaison counsel for multiple defendants, obtained a decision of non-infringement on all patents.
  • Defended a major security software company in a multi-patent action in the District of Delaware. Summary judgment returned invalidating all patents-in-suit prior to trial, resolving a matter seeking approximately $150 million in damages.
  • Served as appellate counsel for a microprocessor manufacturer in appeals to the Federal Circuit from district court and the PTO, resulting in the reversal of a $110 million trial judgment and cancellation of the patent-in-suit.
  • Represented a Fortune 1000 semiconductor company in patent actions concerning power supply technology in the District of Delaware. Jury returned a verdict of infringement in the affirmative patent case, resulting in an award of approximately 75% of damages.
  • On behalf of the scientific research arm of the Australian government, prosecuted multiple patent actions regarding wireless networking technology in the Eastern District of Texas and Northern District of California. A summary judgment of infringement and a permanent injunction were obtained in favor of the client.
  • Prosecuted a copyright, trademark and unfair competition action for the trust of an iconic American photographer in the Northern District of California. Case resolved before trial.
  • Defended a Fortune 500 semiconductor company in the Eastern District of Texas in a multi-patent action regarding wireless networking technology. Case resolved prior to trial.
  • On behalf of a Fortune 100 electronics and consumer products company defended multiple patent actions regarding mobile communications and inventory systems in the Eastern District of Texas. Cases were resolved prior to trial.
  • Defended a copyright action against manufacturer of offshore performance gear in the Southern District of Florida. Case resolved prior to trial.
  • Defended a digital storage manufacturer in patent actions regarding industry standards for dynamic random access memory, including a five-week federal jury trial in the Northern District of California. Obtained remittitur of damages removing nearly 60% of opposing damages award.
  • Served as lead counsel in defense of a trade secret case over allegations of misappropriation of customer lists in the Northern District of California. Case resolved before trial.
  • On behalf of a Fortune 500 company, prosecuted a trade secret and copyright action against a mainland-Chinese startup company in the Northern District of California. Case resolved before trial.
  • Prosecuted trade secret and patent actions regarding video formatting conversion in the Eastern District of Texas and Northern District of California. Both cases resolved prior to trial.
  • Served as lead defense counsel concerning the alleged misappropriation of customer lists and technological know-how in California state court. Case resolved before trial.
