Session Title: Get Your Hands Off My Trust Responsibility? Debating the Federal Government's Role in the Trust Responsibility

Summary: In recent years, the federal government has been “pulling back” from its involvement in tribal affairs – from Indian leasing under the HEARTH Act, to tribal enrollment disputes. Many people in Indian country support a smaller federal role in Indian country, while others are concerned about the continued existence of the trust responsibility. This panel will debate the federal government’s responsibility to Indian tribes on a wide range of issues in a new era of Indian law and policy.
