After three years of litigation and a four week trial, we obtained a defense verdict and $1.8 million attorneys’ fees award against the plaintiff, which purchased commercial property from our client. The big box property had a long-term tenant, a multi-billion retail company, at the time of the sale. After the sale, in the midst of the Great Recession, the tenant filed bankruptcy and closed all of its 180 stores. Plaintiff falsely alleged that our client knew and failed to disclose that the tenant was in severe financial distress at the time of the sale.
We obtained a multi-million dollar judgment for a real estate investment trust against a commercial tenant in Atlanta, Georgia. The tenant had attempted to terminate a commercial lease based on an alleged condemnation arising from a collapsed roof and resulting structural deficiencies. We were able to demonstrate that the tenant had failed to properly maintain the building in violation of the lease. The federal judge wrote that this case "represents a contractual dispute of biblical proportions."
